OUR TERMS OF USE AND PRIVACY POLICY

James Counseling Services (JCS) and its therapists may not conduct some of the data collections and use practices covered in this policy. We are informing you of all standard data collection and use practices typical of ecommerce sites; whereas, JCS is a growing business and may use some of these covered practices in our policy at a later time. To avoid confusion, we want to clarify that there are two types of privacy policies pertaining to JCS and its operations: “clinical” and “ecommerce.” Our clinical privacy policy, referred to as “confidentiality” or “privacy rights and responsibilities,” is covered when completing JCS Intake Forms. A blank pdf copy of these can be found in your member account. A completed copy of the intake paperwork is never loaded or stored onto the JCS website. JCS also wants you to know that creating an account online and booking a free phone consultation does not designate you as a client of JCS nor does it constitute a therapeutic alliance with JCS or its therapists. As such, any therapeutic relationship that does exist between a site member and JCS or its therapists is not reflected solely by the existence of a member account on the JCS website. A therapeutic relationship is only established directly with a JCS therapist upon submission of the required intake forms found in your member account, and whereby the client has signed an informed consent, also known as Patient Rights and Responsibilities. This separate clinical policy can be found in your member portal and is provided on the site for informational purposes only. Non-client visitors of the JCS website are able to create an account and book a phone consultation. Non-client members of the JCS website are also able to request to book a separate appointment. Likewise, booking appointments or requesting to book appointments does not reflect a site member’s status as a client or non-client. Requests to book appointments will be approved for existing clients who have completed, signed, and submitted their intake forms and have been received by JCS through email or mail. Notifications of approved appointments will be visible in the member’s account; therefore, JCS would like to inform you that it is the responsibility of the account creator to do their part to keep their own internet connection, member status, and login information secure. Do not use workplace emails or servers and never give out your password. It is also recommended to change your password every 30 – 90 days. Additional security steps have been taken by JCS and its web-host, Wix.com, to help protect your privacy. JCS does not coerce or mislead visitors into joining our site. Existing clients of JCS prior to the implementation of the JCS “Virtual Appointment Desk” (VAD) are not required nor encouraged to create a member account. New visitors will need to create a member account to have access to VAD and book an appointment; however, it is understood that visitors may choose not to create an account and seek therapy services elsewhere, meaning visitors’ online account creation is strictly voluntary. The JCS website is hosted by web-host, Wix.com, which states the following regarding security for sites created through their hosting service: “All Wix sites have been enabled for HTTPS and come with free web hosting as standard. Wix does not support SSL for domains or subdomains connected to external (non-Wix) websites. Hyper Text Transfer Protocol Secure (HTTPS) is the secure protocol through which your browser communicates with sites. You can see if your site has an SSL certificate if the URL begins with https:// instead of http://.” JCS receives, collects and storse any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only. We collect such Non-personal and Personal Information for the following purposes: 1. To provide and operate the Services; 2. To provide our Users with ongoing customer assistance and technical support; 3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages; 4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 5. To comply with any applicable laws and regulations. The JCS website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail. Our website may track personal information through the use of tracking tools (e.g. cookies, flash cookies, web beacons, etc.,). Google Analytics or other applications offered through our web-host marketplace, Wix App Market, may place cookies or utilize other tracking technologies through Wix’s services or may have their own policies regarding how they collect and store information. As these are external services, such practices are not covered by the Wex Privacy Policy. Cookies are small pieces of data stored on a site visitor’s browser. They are typically used to keep track of the settings users have selected and actions they have taken on a site.
